1 дүгээр зүйл.Хуулийн зорилт

1.1.Энэ хуулийн зорилт нь гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулах ажлыг зохион байгуулахтай холбогдсон харилцааг зохицуулахад оршино.

2 дугаар зүйл.Хаягжуулалтын тухай хууль тогтоомж

2.1.Хаягжуулалтын тухай хууль тогтоомж нь Монгол Улсын Үндсэн хууль, Монгол Улсын засаг захиргаа, нутаг дэвсгэрийн нэгж, түүний удирдлагын тухай, Хот, тосгоны эрх зүйн байдлын тухай, Хот байгуулалтын тухай, Геодези, зураг зүйн тухай, Кадастрын зураглал ба газрын кадастрын тухай, Авто замын тухай, Монгол Улсын нийслэл Улаанбаатар хотын эрх зүйн байдлын тухай хууль, энэ хууль болон эдгээр хуультай нийцүүлэн гаргасан хууль тогтоомжийн бусад актаас бүрдэнэ. /Энэ хэсэгт 2022 оны 4 дүгээр сарын 22-ны өдрийн хуулиар өөрчлөлт оруулсан./

2.2.Монгол Улсын олон улсын гэрээнд энэ хуульд зааснаас өөрөөр заасан бол олон улсын гэрээний заалтыг дагаж мөрдөнө.

3 дугаар зүйл.Гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулахад баримтлах зарчим

3.1.Гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулахад дараах зарчим баримтална:

3.1.1.байр зүйн зурагт суурилсан байх;

3.1.2.засаг захиргаа, нутаг дэвсгэрийн нэгжийн хуваарьт нийцсэн байх;

3.1.3.хаяг давхардахгүй байх;

3.1.4.хаяг үнэн зөв, энгийн, ойлгомжтой байх;

3.1.5.кадастрын бүртгэлээр баталгаажсан байх;

3.1.6.хаягжуулах ажил нэгдсэн арга зүйтэй байх;

3.1.7.хаягийн талаарх мэдээлэл хүртээмжтэй, нээлттэй байх.

4 дүгээр зүйл.Гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулах ажлыг зохион байгуулах

4.1.Гудамж, зам, талбай болон өмчлөх, эзэмших, ашиглах эрх үүссэн үл хөдлөх эд хөрөнгөд байршлын хаяг олгоно.

4.2."Үл хөдлөх эд хөрөнгө" гэж Иргэний хуулийн 84.3-т заасан газар, түүнээс салгамагц зориулалтын дагуу ашиглаж үл болох эд юмсыг ойлгоно.

4.3.Энэ хуулийн 4.1-д заасан үл хөдлөх эд хөрөнгийн байршлын хаяг нь дараах мэдээллээс бүрдэнэ:

4.3.1.нийслэл, аймаг болон сумын төв, засаг захиргаа, нутаг дэвсгэрийн нэгж дэх хот, тосгонд гудамж /зам, талбай, хороолол, хотхон/-ийн нэр, дугаар, хашаа, барилга байгууламжийн нэр, эсхүл дугаар, хаалганы дугаар зэрэг мэдээлэл;

4.3.2.энэ хуулийн 4.3.1-д зааснаас бусад газарт газар зүйн /газар, усны/ нэр, хашаа, барилга байгууламжийн нэр, эсхүл дугаар, хаалганы дугаар зэрэг мэдээлэл.

4.4.Үл хөдлөх эд хөрөнгийн бүртгэл нь уг үл хөдлөх эд хөрөнгийн байршлын хаягийн өмнө засаг захиргаа, нутаг дэвсгэрийн нэгж, хот, тосгоны нэрийг тодотгосон бичвэртэй байна.

4.5.Гудамж, зам, талбайг давхардахгүй байдлаар нэрлэж, дугаарлана.

4.6.Хаягийн тэмдэглэгээний стандартыг газрын харилцааны асуудал эрхэлсэн төрийн захиргааны байгууллага боловсруулж, стандартчиллын асуудал эрхэлсэн төрийн захиргааны байгууллага батална.

4.7.Гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулах журмыг энэ хуульд нийцүүлэн Засгийн газар батална.

4.8.Гудамж, зам, талбай, үл хөдлөх эд хөрөнгийг хаягжуулах ажлыг улс, орон нутгийн төсвөөс санхүүжүүлнэ.

4.9.Засгийн газар хаягжуулалтын тухай хууль тогтоомжийн биелэлтийг зохион байгуулж, хэрэгжилтэд нь хяналт тавьж ажиллана.

4.10.Аймаг, нийслэлийн Засаг дарга нь аймаг, сум, баг, нийслэл, дүүрэг, хорооны гудамж талбай, барилга, орон сууц, хашааг хаягжуулах арга хэмжээг авна. /Энэ хэсгийг 2022 оны 4 дүгээр сарын 22-ны өдрийн хуулиар нэмсэн./

5 дугаар зүйл.Хууль зөрчигчид хүлээлгэх хариуцлага

5.1.Энэ хуулийг зөрчсөн хүн, хуулийн этгээдэд Зөрчлийн тухай хуульд заасан хариуцлага хүлээлгэнэ.

(2023.07.20-ны өдрийн орчуулга) Unofficial translation LAW OF MONGOLIA February 7 , 201 3 Ulaanbaatar city ON ADDRESSING Article 1. Purpose of the L aw 1.1. The purpose of this Law is to r egulate relations related for organizing the works on addressing the street s , road s , areas, and immovable properties . Article 2. L egislation on the addressing 2.1. The legislation on addressing shall consist of the Constitution of Mongolia, the Law on a dministrative and territorial units and their governance , the Law on Legal status of towns and villages, the Law on Urban development, the Geodesy and cartography, the Law on C adastral mapping and land cadaster , the Law on Auto roads , t he Law on L egal status of U laanbaatar, the capital city of Mongolia, this Law , and other legislative acts enacted in conformity therewith. /This paragraph was amended by the law as of April 22, 2022/ 2. 2.If an international treaty , to which Mongolia is a party , provides other wise than this Law , the provisions of the international treaty shall prevail. Article 3.The principles to be adhered to for addressing the street s , road s , area s, and immoveable properties 3.1. The following principles shall be adhered to for addressing the streets, the roads, the areas, and the immoveable properties: 3.1.1. t o be base d on topographic drawing; 3.1.2. to be in compliance with the schedule of administrative and territorial units; 3.1.3. not to be overlapped with respect to t he address; 3.1.4. to be accurate , normal , and clear with respect to the address ; 3.1.5. t o be confirmed by cadastral registration; 3.1.6. to have a unified methodology with respect to t he addressing ; 3.1.7. to be accessible and transparent with respect to the address information . Article 4. O rganiz ing the addressing works of the street s , road s , area s , and immo vable properties 4.1. The streets, roads, areas, and the immovable properties which have the right to own, possess, and use shall be given a location address. 4.2. " Immovable property" means l and and assets that cannot be used for their original purpose when they are in separation with lan d as stated in paragraph 84.3 of the Civil Code . 4.3.The address of the immovable property specified in paragraph 4.1 of this Law shall consist of the following information: 4.3.1. i nformation such as the names and numbers of the streets /roads, areas, khoroolol , khotkhon / , names or numbers of the fences and building, and door numbers in towns and village s located in the center of the C apital city , aimag , soum , as well as located at the admini strati ve and territorial units ; 4.3.2. i nformation such as geographic /land, water/ names, names or numbers of fences and buildings, and door numbers in places other than those specified in sub-paragraph 4.3.1 of this Law : 4.4.The registration of immovable properties shall have a text clarifying the name of the administrati ve and territorial unit, towns and village in front of the address of the location of the immovable property . 4.5.The streets, roads, and areas shall be named and numbered in a non- overlapp ed manner. 4.6. Address marking standar d shall be developed by the State Administrative B ody in charge of land issues, and approved by the State Administrative Body in charge of standardization matter. 4.7. The procedure for addressing streets, roads, area s, and immovable property shall be approved by the Government in accordance wi th this Law . 4.8. Addr essing work of the streets, roads, areas , and immovable property shall be financed from the state and local budget. 4.9.The G overnment shall organize and monitor the enforcement of the legislation on the addressing. 4.10. Governors of aimags and capital city shall take measures to addres s the streets, areas, buildings, apartments , and fence s of aimag s, s o ums, bagh s , the C apital city , districts, and khoroos . /This paragraph was a d ded by the law as of April 22, 2022/ Article 5.Liabilities for violators of the Law 5.1.
