5.1.Эрүүл мэндийн асуудал эрхэлсэн төрийн захиргааны төв байгууллага хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэх, талаар дараах эрх, үүргийг хэрэгжүүлнэ:
5.1.1.хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэхтэй холбогдсон бодлого боловсруулах, энэ асуудлаар гарсан шийдвэрийг хэрэгжүүлэх ажлыг зохион байгуулах;
5.1.2.хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолтой холбогдсон албан ёсны мэдээ, мэдээллийн асуудлыг хариуцах;
5.1.3.энэ хуулийн 12 дугаар зүйлд заасан хүнд болон түүний эхнэр, нөхөр, гэрлэлтээ бүртгүүлээгүй боловч хамтын амьдралтай байгаа хүн, эцэг, эх, хууль ёсны асран хамгаалагч, харгалзан дэмжигчид зөвлөгөө өгөх, эмнэлгийн тусламж, үйлчилгээ үзүүлэх журам батлан мөрдүүлэх;
5.1.4.хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэх чиглэлээр үйл ажиллагаа явуулж байгаа төрийн болон төрийн бус байгууллагад мэргэжил, арга зүйн туслалцаа, дэмжлэг үзүүлэх, хамтран ажиллах;
5.1.5.хөдөлмөрийн асуудал эрхэлсэн төрийн захиргааны төв байгууллагатай хамтран энэ хуулийн 12 дугаар зүйлд заасан хүний хөдөлмөр эрхлэлт болон хөдөлмөрийн чадвар алдалтыг зохицуулсан журам батлах;
5.1.6.хүний дархлал хомсдолын вирусын халдвар илрүүлэх шинжилгээ хийх, энэ хуулийн 10.1.3-т заасан шинжилгээнд хамрагдах талаар зөвлөгөө өгөх журам батлах.
5.2.Энэ хуулийн 5.1-д зааснаас бусад төрийн захиргааны төв байгууллага хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэх талаар дараах эрх, үүргийг хэрэгжүүлнэ:
5.2.1.хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэх тухай хууль тогтоомжийг хэрэгжүүлэх ажлыг салбарынхаа хэмжээнд зохион байгуулж, хэрэгжилтэд хяналт тавих;
5.2.2.хүний дархлал хомсдолын вирусын халдвар, дархлалын олдмол хомсдолоос сэргийлэх сургалт, сурталчилгааны ажлыг холбогдох төрийн байгууллагатай хамтран зохион байгуулах, энэ ажилд салбарынхаа хэмжээнд аж ахуйн нэгж, байгууллагыг татан оролцуулах;
5.2.3.энэ хуулийн 12 дугаар зүйлд заасан хүний эрхийг хангах эдийн засаг, санхүү, эрх зүйн болон хуулиар зохицуулагдаагүй нийгмийн бусад баталгааг бүрдүүлэхэд шаардлагатай арга хэмжээ авах.
14 дүгээр зүйл.Хууль зөрчигчид хүлээлгэх хариуцлага
14.1.Энэ хуулийг зөрчсөн албан тушаалтны үйлдэл нь гэмт хэргийн шинжгүй бол Төрийн албаны тухай хуульд заасан хариуцлага хүлээлгэнэ.
14.2.Энэ хуулийг зөрчсөн хүн, хуулийн этгээдэд Эрүүгийн хууль, эсхүл Зөрчлийн тухай хуульд заасан хариуцлага хүлээлгэнэ.

(2023 . 08 . 0 5 -ны өдрийн орчуулга ) Unofficial translation LAW OF MONGOLIA December 1 3 , 201 2 Ulaanbaatar city ON PREVENTION OF HUMAN IMMUNODEFICIENCY VIRUS INFECTIONS AND ACQUIRED IMMUNE DEFICIENCY SYNDROME /Revised edition/ cHApTER ONE GENERAL PROVISIONS Article 1.Purpose of the L aw 1.1.The purpose of this Law is to determine the activities to be carried out by state and local self-governing organizations and the role of health institutions, medical professionals, citizens, business entities and organizations in preventing human immunodeficiency virus infection and acquired immune deficiency , and to regulate relations in connection with the protection of the rights and legal interests of people who is infected with such virus or have been diagnosed with acquired immunodeficiency syndrome . Article 2.Legislation on prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome 2.1.Legislation on the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome shall consist of the Constitution of Mongolia, the Law on Health, this Law and other legislative acts issued in conformity with the m . 2.2.If an international treaty, to which Mongolia is a party, stipulates otherwise than this Law , the provision of the international treaty shall prevail. Article 3.Definitions of terms of this Law 3.1.The following terms used in this Law shall be understood in the following meanings: 3.1.1 . "human immunodeficiency virus" means a virus /retrovirus/ that selectively damages only the immune cells of the human body; 3.1.2 . "acquired immunodeficiency syndrome " means appearance of diseases and disorders due to the damage of the immune cells of the human body and the loss of the immune system caused by human immunodeficiency virus; 3.1.3 . "prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome " means comprehensive economic, social and legal measures aimed at eliminating the conditions and causes affecting the spread of human immunodeficiency virus infection and reducing its spread. CHAPTER TWO RIGHTS AND OBLIGATION S OF STATE AND LOCAL SELF-GOVERNING BODIE S TO PREVENT HUMAN IMMUNODEFICIENCY VIRUS INFECTIONS AND ACQUIRED IMMUNODEFICIENCY SYNDROME Article 4.Powers of the Government 4.1.The G overnment shall exercise the following powers to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome : 4.1.1.to organize and monitor the implementation of legislation on prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 4.1.2.to develop and implement state policies for the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome , and to take measures related to solving economic, financial, and social problems; 4.1.3.to establish a National Committee responsible for coordinating and organizing activities to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 4.1.4. t o approve the composition and charter of the National Committee specified in sub-paragraph 4.1.3 of this Law . 4.2.The National Committee specified in sub-paragraph 4.1.3 of this Law shall have an office. Article 5.Rights and obligations of the state central administrati ve body 5.1.The state central administrative body in charge of health issues shall have the following rights and obligation s concern ing the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome : 5.1.1.to develop a policy related to the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome , and organiz e the implementation of the decisions made on this issue; 5.1.2.to be responsible for official news and information related to human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 5.1.3. to approve and enforce procedures for providing counseling, medical care and services to the person specified in Article 12 of this Law , his/her spouse, unregistered but cohabiting person, parents, legal guardians, and custodian s; 5.1.4.to provide professional and methodological assistance and support to, and to cooperat e with governmental and non-governmental organizations operating in the field of prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 5.1.5.to approve the procedure on regulating the employment and incapacity for work of the person specified in Article 12 of this Law in cooperation with the state central administrative body in charge of labor issues; 5.1.6.to approve the procedure s on conducting t he tests detecting human immunodeficiency virus infection and providing advice on participating in testing specified in sub-paragraph 10.1.3 of this Law . 5.2. T he state central administrative bodies other than those specified in paragraph 5.1 of this Law , shall have the following rights and obligations concerning the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome : 5.2.1.to organize and monitor the implementation of legislation on the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome in their respective sectors ; 5.2.2.to organize training and promotion work to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome in cooperation with relevant state bodies , and to involve in this work the business entities and organizations of their respective sectors ; 5.2.3.to take necessary measures to create economic, financial, legal and other social guarantees that are not regulated by law to ensure the rights of the person stipulated in Article 12 of this Law . Article 6.Rights and obligation s of local self-governing bodies and governors 6.1.The local self-governing organization shall involve citizens, business entities and non-governmental organizations in training and promotion activities related to the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome within the territory under its jurisdiction, and take measures to re solve the economic, financial and social issue s required in activities to prevent the human immunodeficiency virus infection and acquired immunodeficiency syndrome . 6.2.Governors of all levels shall organize and monitor the implementation of the decisions made by the Government and local self-governing organizations in connection with the implementation of legislation on the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome . chapter tHREE MISCELLANEOUS Article 7. Ob ligations of health care institutions 7.1.Health care organizations shall have the following obligations to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome : 7.1.1. to detect and diagnose human immunodeficiency virus infection and acquired immunodeficiency syndrome , provide medical care and services to people infected with the virus and those with acquired immunodeficiency syndrome , and take epidemiological measures; 7.1.2.to organize the consultation work specified in sub-paragraph 5.1.3 of this Law within the territory under its jurisdiction; 7.1.3.to create conditions that human immunodeficiency virus infection does not spread in the hospital with uncertified blood, blood products, breast milk, donor cells, organs, needles, syringes, and other tools; /this sub-paragraph was amended by the law as of J anuary 19, 2018/ 7.1.4.to create necessary conditions to prevent exposure to human immunodeficiency virus infection by the medical professional at the workplace; 7.1.5.if a medical professional is infected with the human immunodeficiency virus while performing his /her duties, or is exposed to the risk of infection, to immediately take post-exposure preventive measures. 7.2.Provisions specified in paragraph 7.1 of this Law shall apply equally to health care institutions of any form of ownership. Article 8.Rights and obligations of medical professionals 8.1.The medical professional shall have the following rights to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome : 8.1.1. i f blood, blood products, cells, organs, or breast milk from a donor of a person infected with the human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome , as well as suspected human immunodeficiency virus infection, is used for treatment o r care of other people, to obtain epidemiological data from relevant organizations, employees, and citizens; /This sub-paragraph was amended by the law as of January 19, 2018/ 8.1.2.if infected at the workplace or exposed to the risk of infection, to participate in post-exposure prevention measures, and to receive medical care and services. 8.2. Sub-paragraph 8.1.2 of this Law shall appl y to other employees working in healthcare institutions. 8.3.The medical professional shall have the following obligations to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome : 8.3.1.to inform the relevant health institution about the detection and diagnosis of human immunodeficiency virus infection or acquired immunodeficiency syndrome in accordance with the appropriate procedure ; 8.3.2.to propose to the client about testing for human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 8.3.3.to give advice to the relevant person specified in sub-paragraph 5.1.3 of this Law ; 8.3.4.not to refuse to provide medical care and services to a person infected with the human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome ; 8.3.5.not to disclose information about a person infected with human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome in accordance with paragraph 11.3 of this Law . Article 9.Rights and obligations of citizens 9.1.Mongolian citizens shall have the following rights concerning the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome : 9.1.1. to r equire official documents proving the right to perform the examination, analysis, and epidemiologic control for the detection of human immunodeficiency virus infection and acquired immunodeficiency syndrome from the person performing the examination, analysis, and control ; 9.1.2.to obtain accurate and rationale information about the human immunodeficiency virus and acquired immunodeficiency syndrome , and to learn how to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome . 9.2.Mongolian citizens shall have the following obligations concerning the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome : 9.2.1. to participate in events organized by state and local self-governing bodie s, health and other rel evant organizations and business entities to prevent human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 9.2.2.not to violate the rights and legal interests of people infected with human immunodeficiency virus or with acquired immunodeficiency syndrome ; 9.2.3.to protect oneself and others from human immunodeficiency virus infection, and to prevent acquired immunodeficiency syndrome in case of infection ; 9.2.4.not to violate paragraph 11.2 of this Law . 9.3.The provisions specified in paragraphs 9.1 and 9.2 of this Law shall apply equally to foreign citizens and stateless persons residing or passing through the territory of Mongolia. Article 10. Obligation s of business entities and organizations 10.1. Business entities and organizations shall have the following obligations concerning the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome : 10.1.1. to create and implement a program to prevent employees from being exposed to the risk of human immunodeficiency virus infection at the workplace, and ensure occupational safety and hygiene conditions; 10.1.2. to encourage employees to voluntarily participate in testing for human immunodeficiency virus infection; 10.1.3.not to forcibly involve the employee to the testing specified in sub-paragraph 10.1.2 of this Law ; 10.1.4.if the physical health of a person infected with the human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome does not prevent him /her from working or the working conditions do not contradict with it , not to refuse to employ h im/her, and not to dismiss him/her from the employed job; 10.1.5.to protect the confidentiality of employees who have been infected with the human immunodeficiency virus and who have been diagnosed with acquired immunodeficiency syndrome , and not to disclose information about them as specified in paragraph 11.3 of this Law ; 10.1.6. to conduct training in the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome ; 10.1.7. to include in the budget the expenses required for the measures specified in sub-paragraph s 10.1.1 and 10.1.6 of this Law , and spend them for the intended purpose; 10.1.8.not to violate paragraph 11.2 of this Law . Article 11.Protection of rights of people infected with human immunodeficiency virus or with acquired immunodeficiency syndrome 11.1.Unless otherwise provided by law, it shall be prohibited to restrict the rights and freedoms of a person infected with the human immunodeficiency virus or with acquired immunodeficiency syndrome on the grounds of being infected with the human immunodeficiency virus or with acquired immunodeficiency syndrome . 11.2.All forms of stigmatization and discrimination against people infected with human immunodeficiency virus or with acquired immunodeficiency syndrome shall be prohibited. 11.3.Organizations, officials, and citizens shall be prohibited from disclosing information about persons infected with human immunodeficiency virus or persons with acquired immunodeficiency syndrome , except as provided by law. 11.4. T he information specified in paragraph 11.3 of this Law shall include the surna me , the given name, the address of work, school and permanent residence, identification, photo, telephone number, and test results of the person infected with the human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome . 11.5.The amount of work disability of a person infected with the human immunodeficiency virus or diagnosed with acquired immunodeficiency syndrome shall be determined in accordance with Article 30 of the Law on Labor Safety and Hygiene and sub-paragraph 5.1.5 of this Law . Article 12. Obligations of a person infected with human immunodeficiency virus or with acquired immunodeficiency syndrome 12.1.A person infected with human immunodeficiency virus or with acquired immunodeficiency syndrome shall have the following obligations: 12.1.1.to provide accurate and correct information to health care institutions about conditions and causes of getting human immunodeficiency virus infection or acquired immunodeficiency syndrome ; 12.1.2. to refuse to be a donor of blood, breast milk, sperm or other organs; 12.1.3.not to infect others with human immunodeficiency virus infection, to refrain from any actions that may cause it, to protect oneself and others . Article 13.Participation of press and media organizations, non-governmental organizations, and business entities 13.1. Press and media organizations, non-governmental organizations, and business entities shall participate in training and promotion work on the prevention of human immunodeficiency virus infection and acquired immunodeficiency syndrome . 13.2.If a non-governmental organization operating in the field of human rights protection believes that the rights and legal interests of the person stipulated in Article 12 of this Law have been violated, it may file a complaint with the competent authority based on the power of attorney issued by the respective person. Article 14.Liabilities to be imposed on violators of the Law 14 .1.If the actions of officials who violate this Law are not in criminal nature, they shall be held liable as provided in the Law on Civil Service. 14 .2.Any person or legal entity who violates this Law shall be charged with the liability specified in the Criminal Code or the Law on Violations. /This article was modified by the law as of December 4, 2015/ THE CHAIRMAN OF THE STATE GREAT KHURAL OF MONGOLIA ENKHBOLD.Z
