МОНГОЛ УЛСЫН ДЭЭД ШҮҮХИЙН 1988 ОНЫ 12 ДУГААР САРЫН 27-НЫ ӨДРИЙН 34 ДҮГЭЭР ТОГТООЛД ӨӨРЧЛӨЛТ ОРУУЛАХ, 1997 ОНЫ 6 ДУГААР САРЫН 18-НЫ ӨДРИЙН 248 ДУГААР ТОГТООЛЫН ЗАРИМ ЗААЛТЫГ ХҮЧИНГҮЙ БОЛГОХ ТУХАЙ
Сүүлийн жилүүдэд төгрөгийн ханш аажмаар унаж, авто тээврийн хэрэгслэлийн эд анги, түүний сэлбэгийн үнэогцом өсч байгаа тул хөдөлгөөний аюулгүй байдлын эсрэг гэмт хэргийн "бага бус хохирол"-ын хэмжээний доод хязгаарыг нэмэгдүүлэх шаардлага зүй ёсоор гарч ирж байна.
Иймд Монгол Улсын Дээд шүүхийн 1997 оны 6 дугаар сарын 18-ны өдрийн 248 дугаар тогтоолоор хөдөлгөөний аюулгүй эсрэг гэмт хэргээс учирсан шууд хохирлын мөнгөн илэрхийлэлийг "300000 төгрөгөөс дээш" байхаар тогтоосныг өөрчлөх нь зүйтэй гэж үзээд Монгол Улсын Шүүхийн тухай хуулийн 24 дүгээр зүйлийн 3 дахь хэсгийн 6 дугаар заалтыг удирдлага болгон Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
1."Дээд шүүхийн зарим тайлбаруудыг хүчингүй болгох, нэмэлт өөрчлөлт оруулах тухай" Улсын Дээд шүүхийн 1997 оны 6 дугаар сарын 18-ны өдрийн 248 дугаар тогтоолын нэгдүгээр зүйлийн 13 дахь хэсгийн 2 дугаар заалтын "300000 төгрөгнөөс дээш" гэсэн заалтыг хүчингүй болсонд тооцсугай.
2."Хөдөлгөөний аюулгүй байдлын эсрэг гэмт хэргийг шийдвэрлэхэд анхаарах зарим асуудал, цаашид баримтлах чиглэлийн талаар "Дээд шүүхийн Бүгд хурлын 1988 оны 12-р сарын 27-ны өдрийн 34 дүгээр тогтоолын 6 дугаар зүйлийн "300000 төгрөгөөс дээш" гэснийг "600000 төгрөгөөс дээш" гэж өөрчилсүгэй.
3.Энэ тогтоолыг 2000 оны 7 дугаар сарын 1-нээс эхлэн дагаж мөрдөнө.
