ДЭЭД ШҮҮХИЙН ЗАРИМ ТОГТООЛД ӨӨРЧЛӨЛТ ОРУУЛАХ ТУХАЙ
Дээд шүүхийн зарим тогтоолыг Монгол Улсын Үндсэн хууль, Монгол Улсын шинэчлэн найруулсан Эрүүгийн хуулийн заалттай нийцүүлэх зорилгоор Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
Нэг. "Шүүхүүдээс эрүүгийн хэрэгт энгийн магадлал гаргаж байгаа практикийн тухай" Дээд шүүхийн Бүгд хурлын 1965 оны 8 дугаар сарын 27-ны өдрийн 6/21 дүгээр тогтоолын тогтоох хэсгийн 1, 2, 10 дахь заалтаас "социалист" гэсэн үгийг хассугай.
Хоёр. "Шүүхийн таслан шийдвэрлэх тогтоолын чанарыг сайжруулах тухай" Дээд шүүхийн Бүгд хурлын 1971 оны 4 дугээр сарын 7-ны өдрийн 2/9 дүгээр тогтоолд дараах өөрчлөлт оруулсугай:
а/ уг тогтоолын тэмдэглэх хэсгийн 3, 7 дахь өгүүлбэрээс "социалист" гэсэн үгийг, тогтоох хэсгийн 1 дэх заалтаас "социалист", "коммунист" гэсэн үгийг хассугай.
б/мөн тогтоолд орсон "БНМАУ-ын" гэсэн үгийг "Монгол улсын" гэж, уг тогтоолын 10 дугаар заалтын "Эрүүгийн хуулийн 29 дүгээр зүйл" гэснийг "Эрүүгийн хуулийн 36 дугаар зүйл" гэж;
11 дүгээр заалтын "32, 33 дугаар зүйлүүдийг" гэснийг "39, 40 дүгээр зүйлүүдийг" гэж "18 дугаар зүйл" гэснийг "21 дүгээр зүйл" гэж " 22 дугаар зүйлийг" гэснийг "28 дугаар зүйлийг" гэж;
13 дугаар заалтын "30, 31 дугаар зүйлийн" гэснийг "37,38 дугаар зүйлийг" гэж" "32,33 дугаар зүйлүүдийг" гэснийг "39, 40 дүгээр зүйлүүдийг" гэсэн; " 30 дугаар зүйл ба 31 дүгээр зүйлийн" гэснийг "37 дугаар зүйл ба 38 дугаар зүйлийн" гэж " 32 дугаар зүйл буюу 33 дугаар зүйлийн" гэснийг "39 дүгээр зүйл буюу 40 дүгээр зүйлийн" гэж; 31 дүгээр зүйлийн "а" ангийг гэснийг "37 дугаар зүйлийн 3 дахь заалтыг" гэж;
14 дүгээр заалтын "38, 39, 40 дүгээр зүйлд" гэснийг "46 дугаар зүйлд гэж тус тус өөрчлөн найруулсугай.
