Монгол Улсын Дээд шүүхийн Бүгд хурлын 1989 оны 10-р сарын 13-ны өдрийн 28-р тогтоолын 17-р зүйлийн 2 дахь хэсгийг дор дурьдсанаар өөрчлөн найруулсугай.
Эрүүгийн хуулийн 112-р зүйлийн 3 дахь хэсэгт заасан "онц хүнд хор уршиг" гэдэгт: Энэ зүйлийн 2 дахь хэсэгт заасан хүнд гэмтлийн улмаас хохирогч байнгын тахир дутуу буюу сэтгэл мэдрэлийн эдгэршгүй өвчтэй болсон, амиа хорлоход хүрсэн, хүүхэд дутуу төрүүлсэн, үр хөндүүлэхэд хүрсэн зэрэг үр дагавар учирсан байхыг хамааруулан ойлгоно.
Тэгэхдээ гэмт үйлдэл, хор уршиг хоёрын хооронд заавал шууд шалтгаант холбоотой байна.
