text-align:justify"> Шүүхийн тухай хуулийн 50 дугаар зүйлийн 50.2-т заасан "30 хоног"-ийн хугацааг Сахилгын хорооны гишүүн, ажлын албаны ажилтан болон албан тушаалтан, иргэдээс нэг мөр ойлгохгүй байгаагаас шалгах ажилпагаа явуулах хугацаа хэтэрсэн тохиолдолд шүүгчид сахилгын хэрэг үүсгэхгүйгээр татгалзах, нэгэнт үүсгэсэн сахилгын хэргийг зөвхөн энэ хугацаа хэтэрсэн гэдгээр хэрэгсэхгүй болгох тохиолдол нэг биш удаа гарч хуулийн заалтыг нэг мөр, зөв хэрэглэхгүй байна.
text-align:justify"> Иймд Шүүхийн тухай хуулийн 50 дугаар зүйлийн 50.2-т заасан хугацааг нэг мөр ойлгож, зөв хэрэглэх явдпыг хангах зорипгоор Монгол Улсын Үндсэн хуулийн тавьдугаар зүйлийн 1 дэх хэсгийн 4 дэх заалт, Шүүхийн тухай хуулийн 15 дугаар зүйлийн 15.6.5-д заасныг удирдлага болгон Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
text-align:justify"> 1.Шүүхийн тухай хуулийн 50 дугаар зуйлийн 50.2-т заасан "Сахилгын хорооны гишүүн гомдол, хүсэлтийг хүлээн авсан өдрөөс хойш 30 хоногийн дотор сахилгын хэрэг үүсгэх үндэслэлтэи эсэхийг хянаж сахилгын хэрэг үүсгэх, эсхүл үүсгэхээс татгалзах тухай захирамж гаргана" гэснийг "Сахилгын хорооны гишүүн гомдол, хүсэлтийг хүлээн авч, шалгах эрх бүхий албан тушаалтанд шалгуулахаар заалт өгсөн өдрөөс хойш 30 хоногийн дотор тухай шүүгчийн талаар гаргасан гомдол, хүсэлт үндэслэлтэй эсэхийг шалгаж зохих шийдвэр гаргах хугацаа" гэж ойлгох бөгөөд Шүүхийн тухай хуулийн 50 дугаар зүйлийн 50.2-т заасан 30 хоногийн энэ хугацааг хэтрүүлсэн нь шүүгчид холбогдох сахилгын хэргийг үүсгэх буюу үүсгэхээс татгалзах, сахилгын хэргийг хэрэгсэхгүй болгох үндэслэл болохгүйг тайлбарласугай.
