Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
Төрийн болон орон нутгийн өмчийн тухай хуулийн 56 дугаар зүйлийн 1 дэх хэсгийн зарим заалтыг доор дурдсанаар тайлбарласугай:
1.Төрийн болон орон нутгийн өмчийн тухай хуулийн 56 дугаар зүйлийн 1 дэх хэсгийн "Биржийн гадуур арилжиж худалдана" гэдэгт Төрийн өмчийн хорооны шийдвэрээр хувьцаа, ногдол хувийг худалдах замаар хувьчлан хувьцаат компани болсон төрийн өмчит үйлдвэрийн газар, төрийн өмчийн оролцоотой хуулийн этгээдийн хувьцаа, ногдол хувийг чөлөөтэй болон багцалсан хэлбэртэйгээр, уг хуулийн 38-45, 46-54, 58-р зүйлүүдэд заасан дуудлагын худалдаа, уралдаант шалгаруулалт, удирдах үйл ажиллагааны үр дүнг харгалзан хувьчлахын аль нэг аргаар хувийн өмчлөлд шилжүүлэх явдлыг хамааруулан ойлгоно.
2.Төрийн өмчийн үйлдвэрийн газар болон төрийн өмчийн оролцоотой хуулийн этгээдийн төрд оногдох хувьцаа, ногдол хувийг Төрийн өмчийн хорооны шийдвэрээр биржийн гадуур арилжиж худалдах ажиллагаа нь үнэт цаасны тухай хуулийн 9-р зүйлийн 2 дахь хэсгийн заалтаар зохицуулагдах харилцаанд хамаарахгүй.
