Төрийн болон орон нутгийн өмчийн тухай хуулийн 41 дүгээр зүйлийн 1 дэх хэсгийг дор дурдсанаар тайлбарласугай.
1.Төрийн болон орон нутгийн өмчийн тухай хуулийн 41 дүгээр зүйлийн 1 дэх хэсэгт заасан "Дуудлагын худалдааг хөтлөн явуулах Төрийн өмчийн хорооны этгээд…" гэдэгт Төрийн өмчийн хорооны даргын тушаалаар томилогдсон төрийн өмчийн хорооны газар, хэлтэс, тасгийн ахлах мэргэжилтэн, ахлах мэргэжилтэн нар, аймаг, нийслэлд Төрийн өмчийн хорооны даргын тушаалаар томилогдон ажиллаж байгаа төрийн өмчийн төлөөлөгчид түүнчлэн Төрийн өмчийн хороотой гэрээ байгуулан ажиллаж байгаа дуудлагын худалдаа эрхлэн явуулахаар дүрмэндээ зааж зөвшөөрөл авсан аж ахуйн нэгжүүдийн ажилтнуудыг хамааруулан ойлгоно.
2.Төрийн болон орон нутгийн өмчийн тухай хуулийн 31 дүгээр зүйлд заасны дагуу Төрийн өмчийн хорооны зөвшөөрлөөр, хувьчлалаас гадуур, төрийн өмчийг дуудлага худалдаагаар худалдах тохиролцоонд тухайн эд хөрөнгийг эзэмшигч, ашиглагч нь өөрийн албан тушаалтныг томилон дуудлага худалдааг хөтлөн явуулж болно.
