Банкны тухай хуулийн 4 дүгээр зүйл, Төрийн болон орон нутгийн өмчийн тухай хуулийн 9 дүгээр зүйлийн 5, 10, мөн хуулийн 33, 46-54 дүгээр зүйлийг тус тус үндэслэн Улсын Их Хурлын 2005 оны 48 дугаар тогтоолыг хэрэгжүүлэх зорилгоор Монгол банктай зөвшилцсөний дагуу Монгол Улсын Засгийн газраас ТОГТООХ нь:

1.Хадгаламжийн банкийг "Хадгаламжийн банк" хязгаарлагдмал хариуцлагатай компани /ХХК/ болгон өөрчлөн зохион байгуулсугай.

2."Хадгаламжийн банк" ХХК-ийн дүрмийг 1 дүгээр хавсралт ёсоор баталсугай.

3. "Хадгаламжийн банк" ХХК-ийг хувьчлах уралдаант шалгаруулалт /тендер/-ын зар мэдээг 2 дугаар хавсралт, "Хадгаламжийн банк" ХХК-ийг хувьчлах уралдаант шалгаруулалт /тендер/-ын журмыг 3 дугаар хавсралт ёсоор тус тус баталсугай.

4. "Хадгаламжийн банк" ХХК-ийг худалдах доод үнийг 12.000.000.000 /арван хоёр тэрбум/ төгрөгөөр тогтоосугай.

5. Төрийн өмчийн хороо /Д.СУГАР/-нд даалгах нь:

а/"Хадгаламжийн банк" ХХК-ийг хувьчлах уралдаант шалгаруулалт /тендер/-ын зар мэдээг дотоод, гадаадын хэвлэл мэдээллийн хэрэгслээр нийтэд мэдээлж ажилласугай;

б/"Хадгаламжийн банк" ХХК-ийг хувьчлах уралдаант шалгаруулалтыг Төрийн болон орон нутгийн өмчийн тухай хууль, "Уралдаант шалгаруулалт /тендер/-ын журам"-ын дагуу зохион байгуулж явуулсугай;

в/"Хадгаламжийн банк" ХХК-ийг хувьчлах уралдаант шалгаруулалтад ялсан худалдан авагчтай "Уралдаант шалгаруулалт /тендер/-ын журам"-д заасан болзол, нөхцөлийн талаар хэлэлцэж, "Худалдах, худалдан авах тухай гэрээ" байгуулахыг зөвшөөрсүгэй.

6. Энэ тогтоол гарсантай холбогдуулан Засгийн газрын 1996 оны 12 дугаар сарын 5-ны өдрийн 294 дүгээр тогтоолын 1, 2 дугаар зүйлийн "Хадгаламжийн банк" гэснийг хүчингүй болсонд тооцсугай.
