МОНГОЛ УЛСЫН ИХ ХУРЛЫН СОНГУУЛИЙН ХУУЛИЙН ЗАРИМ ЗҮЙЛ, ХЭСГИЙГ ТАЙЛБАРЛАХ ТУХАЙ
Монгол Улсын Их Хурлын дэргэдэх Сонгуулийн ерөнхий хорооны хүсэлтийг үндэслэн Монгол Улсын Их Хурлын Сонгуулийн хуулийн зарим зүйл, хэсгийг нэг мөр ойлгох, зөв хэрэглэх явдлыг хангах зорилгоор Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
Монгол Улсын Их Хурлын Сонгуулийн хуулийн /цаашид "сонгуулийн хууль" гэх/ зарим зүйл, хэсэг, заалтыг дор дурьдсанаар тайлбарласугай:
1. Сонгуулийн хуулийн 42 дугаар зүйлийн 2 дахь хэсэгт заасан "…нөхөн сонгууль явуулахад энэ хуулийн холбогдох заалтыг баримтлах" гэдгийг хуульд нөхөн сонгуулийн тухайд тусгай журам тогтоосноос бусад бүх заалтыг нөхөн сонгуулийн үед ээлжит сонгуулийн нэгэн адил дагаж мөрдөнө гэж ойлгоно. Тухайлбал, Монгол Улсын Их хурлаас нөхөн сонгууль зарлахаас өмнө улсын бүртгэлд бүртгүүлсэн нам, намуудын эвсэл, бие даан нэрээ дэвшүүлэгч зэрэг нь нөхөн сонгох Улсын Их Хурлын гишүүнд нэр дэвшүүлэх эрхтэй байна.
2. Сонгуулийн хуулийн 19 дүгээр зүйлийн 2 дахь хэсгийн "Эвсэл байгуулсан намууд сонгуульд болон шинээр сонгогдсон Улсын Их Хуралд нэгэн этгээд болж оролцох бөгөөд эвслийн аль нэг нам дангаараа /эвслээс гадуур/ нэр дэвшүүлж…болохгүй" гэдгийг эвсэл байгуулсан намууд ээлжит болон нөхөн сонгуульд тус тусдаа бие дааж нэр дэвшүүлж болохгүй гэж ойлгон хэрэглэнэ.
3. Монгол Улсын Их хурлын гишүүнийг нөхөн сонгох сонгуулийн хугацаа нь Монгол Улсын Их Хурлаас товлон зарласан өдрөөс эхлэн Сонгуулийн хуулийн 42 дугаар зүйлд зааснаар 45 хоног байна гэж ойлгох бөгөөд сонгуулийн үе шатны ажлын хугацааг Улсын Их Хурлын гишүүний нөхөн сонгуулийн тухайд тусгайлан заагаагүй бол ээлжит сонгуулийн үе шатны хугацаатай харьцуулан тогтооно.
