(2023 .0 7 . 03 - н ы өдрийн орчуулга ) Unofficial translation LAW OF MONGOLIA June 16, 2009 Ulaanbaatar city ON REGULATION FOR COMPLIANCE WITH THE LAW ON PROHIBIT ION OF MINERAL EXPLORATION AND MINERAL MINING AT HEADWATERS OF RIVERS, PROTECTED ZONES OF WATER RESERVOIRS AND FOREST FUND AREAS Article 1. Prior complying with the Law on Prohibition of Mineral Exploration and mineral mining at headwaters of rivers, protected zones of water reservoirs and forest fund areas , as well as if the license holder requested to continue to proceed activities within the boundaries specified in paragraph 4.3 of the respective law, they shall submit an application to the state administrative body in charge of geology and mining matters within three months after the entry into for date of the Law on Amendments to the Law on regulations for compliance with the Law on Prohibition of Mineral Exploration and mineral mining at headwaters of rivers, protected zones of water reservoirs and forest fund areas which was adopted on February 18, 2015. /This article was amended by the law as of February 18, 2015/ Article 2. 2.1 .The holder of the license for mining issued at the forest fund areas prior to the adoption of the Law on regulations for compliance with the Law on the Prohibition of mineral exploration and mineral mining at headwaters of rivers, protected zones of water reservoirs and forest fund areas which was adopted on July 16, 2009, shall implement the provisions stated in paragraph 8.6, Article 29, paragraph 30.2, and sub-paragraph 42.1.5 of the Law on Forest. The ordinary protection zone of the water reservoir area shall be established at least 200 meters from the bank of water reservoir area according to paragraph 22.3 of the Law on Water. If the area under exploration license overlaps with the ordinary protection zone of water reservoir area and forest fund area, it shall be decided in accordance with the Law on Water and Law on Forest. 2.2 .The state central administrative body in charge of environmental matters, the state administrative body in charge of geology and mining matters, and the governor of the respective aimag shall conclude an agreement with the license holder and implement oversight on the agreement. /This paragraph was amended by the law as of November 11, 2022/ 2.3 .If the holder of the license for mining failed to rehabilitate the area affected by mining, the expenses incurred for rehabilitation shall be reimbursed in coordination with the income earned by each license holder during the period of activities of mining. /This article was added by the law as of February 18, 2015/ Article 3. The procedure on canceling the license issued in the headwaters of rivers, taking relevant measures with respect to areas under the license where extradition has begun in the ordinary protection zone of water reservoirs, and rehabilitating them as well as contract template thereto shall be approved by the Government . These procedure and contracts shall specify the condition for pre-replacement of the 100 percent of the expenses to be spend on environmental protection and rehabilitation by the license holder, and the duties and responsibilities of the officials of the state body with functions to oversee respectively. /This article was added by the law as of February 18, 2015/ Article 4. If the application is not submitted within the period specified in Article 1 of this L aw and the contract specified in Article 2 of this L aw is not concluded, the respective license for the mining shall be revok ed , and the exploration and mining license s shall not be issue d again for that area.
