text-align:center"> ЭРҮҮГИЙН ХУУЛИЙН 181 ДҮГЭЭР ЗҮЙЛИЙН 181.3 ДАХЬ ХЭСГИЙН ЗАРИМ ЗААЛТЫГ ТАЙЛБАРЛАХ ТУХАЙ
Эрүүгийн хуулийн 181 дүгээр зүйлийн 181.3 дахь хэсгийн "зэвсэг", "зэвсгийн чанартай бусад зүйл" гэсэн заалтыг нэг мөр ойлгох, зөв хэрэглэх явдлыг хангах зорилгоор Монгол Улсын Үндсэн хуулийн тавьдугаар зүйлийн 1 дэх хэсгийн 4, Шүүхийн тухай хуулийн 15 дугаар зүйлийн 15.6.5-д заасныг удирдлага болгон Монгол Улсын Дээд шүүхээс ТОГТООХ нь:
1. Эрүүгийн хуулийн 181 дүгээр зүйлийн 181.3 дахь хэсэгт заасан "зэвсэг" гэдэгт иж бүрдэл, бүтцийн хувьд амьд болон бусад биетийг устгах, гэмтээх, мөн бие хамгаалах болон дохио өгөх зориулалттай эд зүйл, тоног төхөөрөмж, хэрэгслийг хамааруулж ойлгоно.
Зэвсэг нь галт, хүйтэн болон хийн, мөн үйлдвэрийн эсхүл гар хийцийн аль нь ч байж болно.
2. "Зэвсгийн чанартай бусад зүйл" гэдэгт ахуйн болон аж ахуйн зориулалт бүхий /тухайлбал, хайч, сэрээ, сүх, хөрөө, халив (отвёртка), хүрз, өрөм, лоом, гал тогооны болон сахлын хутга г.м./ эсхүл хүний биед гэмтэл, эд хөрөнгөд хохирол учруулж болох /тухайлбал, бороохой, ташуур, мод, төмөр, чулуу, шил, зодооны хэрэгсэл, бүх төрлийн химийн шингэн ба хатуу бодис г.м./ эд зүйл, хэрэгслийг ойлгоно.
Зэвсгийн чанартай бусад зүйлийг тусгайлан бэлтгэсэн буюу засаж тохируулсан эсэх нь хэргийг Эрүүгийн хуулийн 181 дүгээр зүйлийн 181.3-т зааснаар зүйлчлэхэд нөлөөлөхгүй.
3. Зэвсэг, зэвсгийн чанартай бусад зүйлийг танхайрах явцдаа хэрэглэсний улмаас хүний биед гэмтэл, эд хөрөнгөд хохирол учирсан эсэхээс үл хамааран хэргийг Эрүүгийн хуулийн 181 дүгээр зүйлийн 181.3-т зааснаар зүйлчилнэ.
