Монгол Улсын Дээд шүүхийн Бүгд хурлаас ТОГТООХ нь:
Монгол Улсын Их Хурлын Сонгуулийн хуулийн зарим зүйл, хэсгийг тайлбарлах тухай Дээд шүүхийн Бүгд хурлын 1992 оны 5 дугаар сарын 1-ний өдрийн 30 дугаар тогтоолын 1 дүгээр зүйлийн 6 дахь хэсгийн дараа дор дурдсан агуулгатай 7, 8, 9 дэх хэсэг нэмж, 7, 8, 9, 10, 11 дүгээр хэсгийг 10, 11, 12, 13, 14 дүгээр хэсэг болгосугай:
7/Сонгуулийн хуулийн 2 дугаар зүйлийн 2 дахь хэсгийн "Аль нэг намын гишүүнийг өөр намын өмнөөс нэр дэвшүүлж үл болно" гэсэн заалтад намын гишүүнээс түдгэлзвэл зохих албан тушаалын тухай БНМАУ-ын хуульд зааснаар намын гишүүнээс түдгэлзсэн албан тушаалтан нэгэн адил хамаарна.
8/Сонгуулийн хуулийн 24 дүгээр зүйлийн 4 дэх хэсгийн "…Гарын үсэг хуурамчаар үйлдвэл …" гэдэгт бусдыг төлөөлөн буюу батлагдсан маягтаас өөр хуудсанд гарын үсэг зуруулсан, хүч хэрэглэх, хуурч мэхлэх, заналхийлэх эд мөнгө, эсхүл бусад аргаар татах замаар гарын үсэг зуруулсан, түүнчлэн Сонгуулийн хуулийн 1 дүгээр зүйлийн 2 дахь хэсэгт заасан сонгуулийн эрхгүй хүмүүсээр гарын үсэг зуруулсан зэргийг хамааруулан ойлгоно. Харин Сонгуулийн хуулийн 35 дугаар зүйлийн 4 дэх хэсэгт заасан саналаа өөрөө тэмдэглэж чадахгүй сонгогчийн өмнөөс, түүний зөвшөөрснөөр итгэмжилсэн хүн нь гарын үсэг зурсан байж болно.
9/Сонгуулийн хуулийн энэ зүйл, хэсгийн "Гарын үсгийг хуурамчаар үйлдвэл тухайн хүнийг Улсын Их Хурлын гишүүнд нэр дэвшүүлснийг сонгуулийн тойргийн хороо хүчингүйд тооцно" гэсэн заалтыг хэрэглэхдээ хуурамчаар үйлдсэн гарын үсгийн тоог нийт дэмжигчийн тооноос хасаж тооцох бөгөөд ийнхүү хасахад үлдсэн гарын үсгийн тоо 801-д хүрэхгүй тохиолдолд нэр дэвшүүлснийг хүчингүйд тооцохоор ойлговол зохино.
