text-align:center"> ХОХИРОГЧИД НӨХӨХ ОЛГОВОР ОЛГОХ ТУХАЙ ХУУЛИЙН ЗАРИМ ЗҮЙЛ, ЗААЛТЫГ ШҮҮХИЙН ПРАКТИКТ ХЭРЭГЛЭХ ТУХАЙ
Хохирогчид нөхөх олговор олгох тухай хуулийн зарим зүйл, заалтыг нэг мөр ойлгож, зөв хэрэглэх явдлыг хангах зорилгоор Монгол Улсын Үндсэн Хуулийн Тавьдугаар зүйлийн 1 дэх хэсгийн 4 дэх заалт, Шүүхийн тухай хуулийн 15 дугаар зүйлийн 15.6.5.-д заасныг удирдлага болгон Улсын Дээд шүүхээс ТОГТООХ НЬ:
1. Хохирогчид нөхөх олговор олгох тухай хуулийн (цаашид хуулийн гэх) 4 дүгээр зүйлийн 4.1.4., 4.2.-т заасан хохирлын хэмжээ нь "шүүхийн шийдвэрээр тогтоогдсон" байна гэдэг нь Эрүүгийн байцаан шийтгэх хуулийн 301, Иргэний хэрэг шүүхэд хянан шийдвэрлэх тухай хуулийн 120 дугаар зүйлд тус тус зааснаар хүчин төгөлдөр болсон эрүү, иргэний хэргийн тогтоол, шийдвэрт заагдсан байхыг хэлнэ.
2. Хуулийн 5 дугаар зүйлд заасны дагуу хохирогчид улсын төсвөөс нөхөх олговор олгох нь Иргэний хуулийн 497 дугаар зүйлийн 497.1.-д зааснаар гэм буруутай этгээдэд хариуцлага тооцож байгаа явдал биш учир хохирол учруулсан этгээдийг гэм хорыг арилгах хуульд заасан үүргээс чөлөөлөх үндэслэл болохгүй.
Эд хөрөнгийн болон эдийн бус хохирлын хэмжээг шүүхээр тогтоолгосноор улсын төсвөөс нөхөх олговор авах эрх үүсэх учир хохирлын хэмжээ тогтоолгох тухай хохирогчийн шаардлагыг Иргэний хэрэг шүүхэд хянан шийдвэрлэх тухай хуулийн 12 дугаар зүйлийн 12.1.3.-т заасан иргэний хэрэг үүсгэх үндэслэлтэй адилтгаж болно.
Хохирлын хэмжээ тогтоосон шүүхийн шийдвэрт улсын төсвөөс нөхөх олговор гаргуулах асуудлыг нэг мөр шийдвэрлэнэ.
