1.1.Энэ хуулийн зорилт нь Дорноговь аймгийн Алтанширээ сумын нутаг дэвсгэрт дотоодын түүхий эдэд түшиглэсэн Газрын тос боловсруулах төрийн өмчит үйлдвэр /цаашид "Газрын тос боловсруулах үйлдвэр" гэх/-ийг байгуулах болон түүхий тос дамжуулах хоолой барих үйл ажиллагаанд төрөөс дэмжлэг үзүүлэхтэй холбогдсон харилцааг зохицуулахад оршино.
2.1.Газрын тос боловсруулах үйлдвэрийг дэмжих хууль тогтоомж нь Монгол Улсын Үндсэн хууль, Газрын тосны тухай хууль, Газрын тосны бүтээгдэхүүний тухай хууль, Барилгын тухай хууль, Усны тухай хууль, Стандартчилал, техникийн зохицуулалт, тохирлын үнэлгээний итгэмжлэлийн тухай хууль, энэ хууль болон эдгээр хуультай нийцүүлэн гаргасан хууль тогтоомжийн бусад актаас бүрдэнэ.
2.2.Монгол Улсын олон улсын гэрээнд энэ хуульд зааснаас өөрөөр заасан бол олон улсын гэрээний заалтыг дагаж мөрдөнө.
3.1.Энэ хуулиар Газрын тос боловсруулах үйлдвэр байгуулах болон түүхий тос дамжуулах хоолойн үндсэн технологийн ба дагалдах, туслах байгууламжийг барьж, ашиглалтад оруулах, үйл ажиллагааг зохион байгуулахад чиглэсэн эрх зүйн орчныг бүрдүүлэх, түүнд төрөөс дэмжлэг үзүүлэхтэй холбогдсон харилцааг зохицуулна.
3.2.Энэ хуулиар зохицуулаагүй Газрын тос боловсруулах үйлдвэртэй холбогдсон харилцааг холбогдох бусад хуулиар зохицуулна.
3.3.Энэ хуульд заасан харилцааг нарийвчлан зохицуулах Газрын тос боловсруулах үйлдвэрт төрөөс дэмжлэг үзүүлэх журмыг Засгийн газар батална.
3.4.Энэ хуулийг Газрын тос боловсруулах үйлдвэр бүрэн хүчин чадлаараа ажиллах хүртэлх хугацаанд хүчин төгөлдөр мөрдөнө.
4.1.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолой, тэдгээрийн үндсэн технологийн ба дагалдах, туслах байгууламжийн зураг төслийг гэрээ үйлдсэн хэлээр боловсруулж болох бөгөөд магадлал хийх, барилгын ажил гүйцэтгэх, үе шатны ажилд хяналт тавих, чанар аюулгүй байдлын шинжилгээ хийх, ашиглалтад оруулж, гэрчилгээжүүлэх харилцааг энэ хуулийн 3.3-т заасан журмаар зохицуулна.
4.2.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолой, тэдгээрийн үндсэн технологийн ба дагалдах, туслах байгууламжийн зураг төслийг боловсруулах, магадлал хийх, барилгын үйл ажиллагаанд олон улсын норм, дүрэм, стандартыг гэрээ үйлдсэн хэлээр хэрэглэж болно.
4.3.Энэ хуулийн 4.2-т заасан олон улсын норм, дүрэм, стандартыг гэрээ үйлдсэн хэлээр бүртгэх, хэрэглэх харилцааг энэ хуулийн 3.3-т заасан журмаар зохицуулна.
4.4.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолойн ашиглалтын үйл ажиллагаанд шаардагдах олон улсын норм, дүрэм, стандартыг монгол хэлнээ орчуулж, Стандартчилал, техникийн зохицуулалт, тохирлын үнэлгээний итгэмжлэлийн тухай хуулийн 25.3.2-т заасны дагуу бүртгүүлж, мөрдөнө.
4.5.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолой, тэдгээрийн үндсэн технологийн ба дагалдах, туслах байгууламжийн барилгын ажлын зөвшөөрөл олгох асуудлыг Барилгын тухай хуулийн 32.1.5-д заасныг үндэслэн энэ хуулийн 3.3-т заасан журмаар зохицуулна.
5.1.Газрын тос боловсруулах үйлдвэр түүхий эдийн тогтвортой нөөцтэй байх зорилгоор газрын тосны хайгуул, ашиглалтын үйл ажиллагаа явуулж болно.
5.2.Энэ хуулийн 5.1-д заасан газрын тосны хайгуул, ашиглалтын үйл ажиллагаа явуулах талбайг давуу эрхээр олгох асуудлыг Засгийн газар шийдвэрлэнэ.
5.3.Газрын тосны хайгуул, ашиглалтын үйл ажиллагааг гадаад, дотоодын аж ахуйн нэгжтэй хамтран явуулж болох бөгөөд энэ хуулийн 5.2-т заасан Засгийн газрын шийдвэрийг үндэслэн гэрээ байгуулна.
5.4.Газрын тосны асуудал хариуцсан төрийн захиргааны байгууллага энэ хуулийн 5.2-т заасны дагуу олгогдсон талбайд өмнө хийгдсэн геологи, геофизик, гидрогеологи, геохими, өрөмдлөг зэрэг хайгуулын ажлын анхдагч болон боловсруулалт хийгдсэн тайлан, материал, мэдээллийг Газрын тос боловсруулах үйлдвэрт үнэ төлбөргүй шилжүүлнэ.
5.5.Газрын тосны асуудал эрхэлсэн төрийн захиргааны төв байгууллага энэ хуулийн 5.2-т заасныг үндэслэн Газрын тос боловсруулах үйлдвэрт газрын тосны хайгуул, ашиглалтын тусгай зөвшөөрлийг олгоно.
5.6.Газрын тос боловсруулах үйлдвэрт Засгийн газраас олгосон талбайд газрын тосны хайгуул, ашиглалттай холбогдсон үйл ажиллагааг энэ хуулийн 3.3-т заасан журмаар зохицуулна.
6.1.Газрын тос боловсруулах үйлдвэрт төрөөс дараах дэмжлэг үзүүлнэ:
6.1.1.бүтээн байгуулалтад оролцох ажиллах хүч, мэргэжилтэн гадаадаас авахтай холбогдсон харилцааг энэ хуулийн 3.3-т заасан журмаар зохицуулах;
6.1.2.газрын доорх усны нөөцөд улсын төсвийн хөрөнгөөр судалж тогтоосон газрын доорх усны нөөцийн эрэл, хайгуул, судалгааны зардлын төлбөрөөс Газрын тос боловсруулах үйлдвэрийг чөлөөлөх;
6.1.3.барилга угсралтад шаардлагатай машин механизм, техник, тоног төхөөрөмж, дагалдах хэрэгсэл, түүхий эд, бараа материалын тээвэрлэлтийг энэ хуулийн 3.3-т заасан журмаар зохицуулах;
6.1.4.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолойн аюулгүй байдал, харуул хамгаалалтыг энэ хуулийн 3.3-т заасан журмаар зохицуулах;
6.1.5.барилга угсралтад шаардагдах машин механизм, техник, тоног төхөөрөмж, дагалдах хэрэгсэл, түүхий эд, бараа материалыг гаалийн хилээр нэвтрүүлэхдээ Гаалийн тухай хуульд заасны дагуу гаалийн түргэвчилсэн бүрдүүлэлтийг хийх;
6.1.6.Газрын тос боловсруулах үйлдвэр болон түүхий тос дамжуулах хоолой барих, газрын тосны хайгуул, ашиглалтын үйл ажиллагаа явуулахад орон нутгийн удирдлагаас дэмжлэг үзүүлэх.

LAW OF MONGOLIA

ON SUPPORTING OIL REFINERY
CHAPTER ONE
GENERAL PROVISIONS
Article 1.Purpose of the Law
1.1. The purpose of this law is to regulate relations pertaining to the establishment of a state-owned Oil Refinery Plant in the territory of Altanshiree soum of Dornogovi p rovince based on domestic raw materials /hereinafter referred to as "Oil Refinery" / and the government's support for the construction of crude oil pipelines .
Article 2. Legislation on Supporting Oil Refinery
2. 1. Legislation on supporting the oil refinery comprises of the Constitution of Mongolia, the Law on Petroleum, the Law on Petroleum Products, the Construction l aw, the Water l aw, the Law on Standardization, Technical Regulation and Accreditation of Conformity Assessment, this law and other legislative acts enacted in conformity with them .
2. 2. If an international treaty, to which Mongolia is party, provides otherwise than this law , the n the provision of such international treaty shall prevail .
Article 3. Scope of the Law
3. 1. This law regulates relations pertaining to the creation of a legal environment for the establishment of oil refiner y plant and the construction and commissioning of basic technological and supporting facilities for its crude oil pipelines, as well as the organization of activities, and the government's support for such construction.
3. 2. Any r elations pertaining to the Oil Refinery that are not regulated by this law shall be governed by other relevant laws.
3. 3. The Government shall approve the detailed procedure for the government support to oil refineries that will regulate the relations stipulated in this law.
3. 4. This law shall be in force until the Oil Refinery operates at its full capacity.
CHAPTER TWO
GOVERNMENT SUPPORT FOR OIL REFINERY
Article 4. Construction activities of oil refiner y and crude oil pipelines, and their main technology and supporting facilities
4. 1. T he design of the oil refinery and crude oil pipeline s and their main technology and supporting facilities may be developed in the language of the contract, and any relations pertaining to verification, construction work s , supervis ion on work stages, quality and safety analysis, commissioning and certification shall be regulated by the procedure specified in Article 3.3 of this law.
4. 2. The i nternational norms, rules, and standards may be used in the language of the contract for the design, verification and construction of oil refineries and crude oil pipelines and their main technolog y and supporting facilities.
4. 3. Any r egistration and application of international norms, rules, and standards specified in Article 4.2 of this law in the language of the contract shall be governed by the procedure specified in Article 3.3 of this law.
4. 4. The international norms, rules, and standards required for the operation of oil refineries and crude oil pipelines shall be translated into the Mongolian language and be registered and in effect in accordance with Article of 25.3.2 of the Law on Standardization, Technical Regulation and Accreditation of Conformity Assessment .
4. 5. The issue o n construction permits for oil refineries and crude oil pipelines and their main technolog y and supporting facilities shall be regulated by the procedure specified in Article 3.3 of this Law based on Article 32.1.5 of the Construction Law.
Article 5. Oil Exploration and Exploitation Operation of Oil Refinery
5. 1. The oil refinery may carry out oil exploration and exploitation activities in order to ensure a stable supply of raw materials.
5. 2. The government shall solve an issue on priority for allocati on of areas for oil exploration and exploitation activities as specified in Article 5.1 of this law.
5. 3. Oil exploration and exploitation activities may be carried out jointly with foreign and domestic business entities , and contracts shall be concluded based on the decision of the Government specified in Article 5.2 of this law.
5. 4. The state central administrative body in charge of oil issues shall transfer the preliminary and processed reports, materials and information of previous exploration , g eolog ical , geophysic al , hydrogeolog ical , geochemistry and drilling works to the Oil Refinery free of charge that were carried out within the area granted in accordance with Article 5.2 of this law.
5. 5. The state central administrative body in charge of oil issues shall grant a license for oil exploration and exploitation to the Oil Refinery based on Article 5.2 of this law.
5. 6. A ny a ctivities related to oil exploration and exploitation conducted with in the areas granted by the government to oil refiner y shall be regulated in accordance with the procedure specified in Article 3.3 of this law.
Article 6. Other Supports
6. 1. The government will provide the following support s to oil refineries:
6.1.1. to regulate the relations pertaining to hiring labor force and experts from abroad in the construction according to the procedure specified in Article 3.3 of this law ;
6.1.2. to e xempt the Oil Refinery from the payment of expenses for prospecting, exploration and research of underground water resources determined by state budget funds;
6.1.3. to regulate the transportation of machinery, equipment, accessories, raw materials, and inventory or goods necessary for construction in accordance with the procedure specified in Article 3.3 of this law;
6.1.4. to r egulate the safety and security of oil refineries and crude oil pipelines in accordance with the procedures specified in Article 3.3 of this law;
6.1.5. to ensure expedited customs clearance in accordance with the Customs l aw when entering machinery, equipment, accessories, raw materials, and inventory or goods required for construction through the customs border;
6.1.6. t o provide support from the local management for the construction of oil refineries and crude oil pipelines, oil exploration and exploitation activities ;
