WATERWAY TRANSPORTATION LAW OF MONGOLIA

CHAPTER ONE
GENERAL PROVISIONS
Article 1. Purpose of the Law
1.1. The purpose of this Law shall be to determine the conditions and requirements for the activities to transport the passengers and shipments through waterway transportation crafts and regulating relations pertaining to the utilization of waterway transportation crafts.
1.2. Unless otherwise provided by any other law, the relations on using special-purpose waterway transportation crafts for public purposes shall be regulated in accordance with this law.
Article 2. Legislation
2.1 . The legislation on waterway transportation consists of the Constitution of Mongolia, this law and other legislative acts enacted in conformity therewith.
2.2 . If an international agreement to which Mongolia is a party states otherwise than this law, the provisions of the international agreement shall prevail.
2.3. In the case of foreign legal entities and citizens conduct transportation by waterway transportation craft in the territory of Mongolia, the laws and regulations of the country shall be adhered, unless otherwise stated in international agreements to which Mongolia is a party.
Article 3. Definitions of terms in Law
3.1 . The following terms used in this Law shall be defined as follows:
3.1.1 . "waterway" means a natural or artificial watercourse made with buoys and navigational signs for the safe passage of waterway transportation vehicles;
3.1.2 . "waterway transportation" means the transportation of passengers and shipments conducted by waterway transportation vehicles in the waters of rivers and lakes;
3.1.3 . "waterway transportation craft" means all types of vessels engaged with transporting passengers and shipments through waterway, tugboats, trailers, submarines, recreational and sports boats, inflatable boats, jet skis, floating devices and engineering floating structures.
3.1.4 . "Special purpose waterway craft" means waterway crafts engaged with military, police, emergency, border guard, and customs organizations that implement special functions of the state;
3.1.5 . "owner of waterway transportation craft " means a person who legally owns a waterway transportation craft and using it for transportation of passengers and shipment;
3.1.6 . "passenger" means a person who is travelling on board of the waterway transportation craft;
3.1.7 . "shipment" means the goods being transported by waterway transportation;
3.1.8 . "transportation" means works and services related to the transfer of passengers and shipment from one berth to another through waterway transportation;
3.1.9 . "carrier" means a person engaged in waterway transportation works and services;
3.1.10 . "customer" means the user of waterway transportation services;
3.1.11 . "berth" means a shore structure which is fully equipped with lighting and rescue equipment intended for the embarkation and disembarkation of passengers as well as the loading and unloading of cargo;
3.1.12 . " transportation document" means a document confirming and marking the loading and receipt of passengers and cargo;
3.1.13 . "Waterway central dock" means a complex station which includes areas for maintenance of waterway crafts, fuel distribution, passenger cabins, cargo and luggage storage warehouse, medical first aid treatment, storage for tools and equipment of search and rescue team and other necessary rooms supplied with electrical power.
3.1.14 . "helmsman" means a person who is authorized to drive a waterway craft specified in Article 8.1 of this law;
3.1.15 . "certified helmsman" means a helmsman who has received a professional license by participating in a training program in accordance with the regulations approved by the competent authority for the purpose of providing work services on waterway crafts;
3.1.16 . "interstate transportation" means transportation through waterway crossing the border of Mongolia;
3.1.17 . "interprovincial transportation" means transportation through the territory of cities and provinces;
3.1.18 . "waterway target" means berth of waterway craft, central dock, lighthouse and other floating equipment.
CHAPTER TWO
PLENARY POWER OF STATE BODY
ON WATERWAY TRANSPORTATION
Article 4. Plenary Power of the State Great Khural of Mongolia
4.1 . The State Great Khural of Mongolia shall exercise the following plenary powers on waterway transportation:
4.1.1 . To ratify the agreements related to international waterway transportation;
4.1.2 . To verify the implementation of laws and regulations on waterway transportation.
Article 5. Plenary Power of the Government of Mongolia
5.1 . The Government shall exercise the following plenary powers on waterway transportation:
5.1.1 . To implement the government's policy on waterway transportation;
5.1.2 . To ensure the implementation of laws and regulations on waterway transportation;
5.1.3 . To implement the control over the implementation of legislation on waterway transportation and approving rules on state control over waterway transportation;
5.1.4 . To approve the regulations establishing requirements on hygiene, epidemiologic, and quarantine for imported waterway crafts;
5.1.5 . To set different payment standards for technical inspection considering the classification and intended use of waterway transportation crafts.
Article 6. Plenary power of the central state administrative body in charge of waterway transportation affairs
6.1 . The Central State Administrative Body in charge of waterway transportation affairs shall exercise following plenary powers:
6.1.1 . To develop and implement the government policy on waterway transportation;
6.1.2 . To organize the implementation of laws and government decisions on waterway transportation;
6.1.3 . To issue, extend, suspend, restore and revoke special licenses to operate waterway transport crafts according to their intended use;
6.1.4 . To approve the interstate and interprovincial transportation routes on waterway network;
6.1.5 . To approve common rules, procedures, norms, and standards on transportation activities, waterway crafts, waterway central dock, berth, rescue tools, and technical use of equipment, and ensuring its implementation;
6.1.6 . To participate in international activities on waterway transportation issues and negotiating with the relevant country on the amount of passengers and shipments to be transported interstate along with transportation safety and service quality requirements;
6.1.7 . To develop the methodology of price and tariffs for passenger and shipment transportation through waterway and taking control over them;
6.1.8 . To develop rule on safe navigation of waterway crafts and getting approval of it;
6.1.9 . To approve the regulation and training program on preparing waterway transportation personnel, helmsman, and certified helmsman in cooperation with the central state administrative body in charge of vocational education and training;
6.1.10 . To transfer the functions and obligations to prepare, advancing education and retraining professional staffs in waterway transportation sector specified in Article 6.1.9 of this Law to relevant state and non-government professional organizations, in case the requirements stated in Article 42.1, 42.5, and 42.6 of the Law on Education are met;
6.1.11 . To issue, extend, suspend or revoke certificates for objects related to the safety of waterway transportation;
6.1.12 . To approve regulation on issuance of certificates to the objects related to the safety of waterway transportation and form of such certificates;
6.1.13 . To approve the rules for the technical use of waterway targets and waterway crafts;
6.1.14 . To transfer some functions to state and non-government professional organizations on the basis of contracts.
Article 7. Plenary power of governors of provinces, capitals, sums and districts
7.1 . The governors of provinces, capitals, sums and districts shall exercise the following plenary powers on waterway transportation:
7.1.1 . to solve the issue of regulation of waterway transportation in pertaining territory in cooperation with the central state administrative body coordinating with the government policy on waterway transportation and to organize its implementation;
7.1.2 . To ensure the implementation of laws and legislation on waterway transportation in pertaining territory, the decision of government, central state administrative body in charge of waterway transportation and the citizens' representative khural ;
7.1.3 . To implement waterway transportation control in the pertaining territory in cooperation with the central state administrative body in charge of waterway transportation and general agency for specialized investigation, and making decision on including the necessary funding for it into the annual state and local budgets and other sources;
7.1.4 . To approve the transportation of passengers and goods by waterway crafts in the local waterway network, the direction of travel, the beginning and end of the sailing season, and the zone in accordance with the purpose and capacity of the waterway crafts in cooperation with the local environmental affairs organization;
7.1.5 . To take control over the repair, maintenance, protection, and use of local waterway signs, marks, and berths along with making decisions on including its funding into the annual state and local budgets and other sources;
7.1.6 . To coordinate the operations of berths, central dock, and other floating structures owned by the locality and their use by users with appropriate fees;
7.1.7 . To make decision on whether or not to establish a non-permanent rescue unit for waterway transportation during the navigational season considering the local needs, cooperating with the local emergency department and captains, owners, helmsman and certified helmsman of waterway crafts, taking control over them, and budgeting the relevant funding in the annual state and local budgets and other sources;
7.1.8 . To publicize laws and regulations on water transportation in cooperation with the central state administrative body in charge of water transportation, relevant government organizations, and state administrative body in charge of emergencies and organizing its implementation.
CHAPTER THREE
REGISTRATION OF WATERWAY TRANSPORTATION CRAFT, SPECIAL LICENSE ON CONDUCTING ACTIVITIES AND SERVICES OF WATERWAY TRANSPORTATION
Article 8. Registration of transportation craft
8.1 . Waterway transportation crafts with an engine power of more than ten horsepower or a length of more than three meters and waterway crafts with a power of less than ten horsepower or a length of not more than three meters, but engaged in any activities and services shall be registered in accordance with the procedure specified in Article 16.3 of this law.
8.2 . Registration of recreational waterway crafts other than those specified in Article 8.1 of this Law shall be conducted by the local administrative body in accordance with the procedure specified in Article 16.3 of this Law.
8.3 . The ancestor or owner of the waterway transportation crafts stated in Article 8.1 of this law shall submit registration to the central state administrative body in charge of waterway transportation, or the administrative organization authorized by it, and obtain certificate of craft. The type, name, number, intended use, capacity, year of manufacture, engine and cabin number, name and address of the ancestor or owner, transfer and removal of other necessary information shall be recorded in such certificate.
8.4 . The movement of waterway craft must be registered.
8.5 . Number of waterway transportation craft shall be issued by the central state administrative body in charge of waterway transportation and the administrative organization authorized by it.
8.6 . The name and number of the waterway transportation craft shall be marked in the visibility area of the craft in a bright color that is different from the background color.
8.7 . The National flag of Mongolia shall be flown on the registered waterway transportation craft.
Article 9. Special license
9.1 . Special license shall be issued to the entities and citizens engaged in waterway transportation services in accordance with the Law on Licenses.
/ In this section, the phrase " law on special license" was changed into as "Law on License" by the law dated June 17, 2022, and it will be enforced from January 1, 2023/.
9.2 . Entities and citizens willing to obtain a special license shall meet the following conditions and requirements:
9.2.1 . professional personnel to perform works and services, completeness of documentation for waterway transportation crafts, designated routes and safety requirements;
9.2.2 . conditions set out by the standards, rules and regulations approved by the competent authority to apply to the work or service.
9.3 . The authority authorized to grant special licenses specified in this law shall conclude contracts with entities and citizens having special licenses.
9.4 . In the case of several interested parties apply for waterway transportation work and services, a special license may be granted by selection, taking into account the demand and needs of the work or service and the fulfillment of the requirements for waterway transportation.
Article 10. Technical requirements for waterway transportation crafts
10.1 . The technical requirements for waterway transportation crafts shall be approved by the central state administrative body in charge of waterway transportation.
10.2 . The technical requirements stated in Article 10.1 of this law shall apply to special-purpose waterway crafts at the same time.
10.3 . Waterway transportation crafts shall be categorized as minor( up to five meters in length, having no more than four seats), small (five to twenty meters in length, having no more than twelve seats), medium (up to twenty fifty meters in length), and large (fifty meters in length and longer).
10.4 . Minor and small waterway transportation crafts specified in Article 8.1 of this Law shall be handled by helmsman or certified helmsman whilst the medium and large waterway transportation crafts shall be handled by captain.
10.5 . The Article 10.4 of this Law shall not apply to waterway transportation crafts specified in Article 8.2 of this Law.
10.6 . The captain shall be majored in ship engineering.
CHAPTER FOUR
WATERWAY TRANSPORTATION
Article 11. Carry out transportation
11.1 . Waterway transportation shall be carried out in accordance with the Civil Code and the contract in compliance with this law.
11.2 . The rule on transportation of passengers and shipments through waterways and regulation on transportation of goods that may pose a danger to human life, health, or the environment, shall be approved by the member of the Government in charge of waterway transportation.
Article 12. Carrier's rights and obligations
12.1 . The Carrier shall have the following rights:
12.1.1 . To refuse to transport passengers who have not purchased a ticket in advance, who have not paid the transportation fee, and shipment that has not been prepared in accordance with the conditions of transportation;
12.1.2 . To require captains, crew members, ancestors, owners, helmsman and passengers of waterway transportation crafts to maintain social order and comply with internal rules and regulations of transportation services;
12.1.3 . To issue guidelines and instructions for ensuring the safety of navigation of waterway transportation crafts, protecting the integrity of transporting shipments, and the life and health of passengers, as well as issuing and enforcing instructions to be adhered on waterway transportation crafts;
12.1.4 . To equip the waterway berth constructed with own funds in accordance with the relevant laws and regulations for meeting relevant requirements, letting own and rent it;
12.1.5 . other rights provided by law.
12.2 . The carrier has following obligations:
12.2.1 . To provide the carrier with accurate information about his/her transportation services, not to cause danger or damage to passengers' lives, health, or cargo, and not to pollute the environment;
12.2.2 . To transport passengers comfortably and safely without danger or accidents by means of special waterway transportation crafts that meet the transportation conditions and technical requirements, and to provide passengers with means, tools, and equipment to protect passengers in the event of an emergency;
12.2.3 . To transport passengers and shipments according to predetermined routes and timetables;
12.2.4 . captains, crew members, ancestors, owners, and drivers of waterway transport vehicles must ensure the conditions for fire prevention, safety of navigation, prevention of environmental pollution, and public health and peace;
12.2.5 . To promptly notify the state administrative organization in charge of emergency issues in the locality, in case of danger or accident occur during waterway transportation;
12.2.6 . To receive regularly hydrometeorological and environmental data from the local hydrometeorological and environmental monitoring organization at the start of waterway transportation and during transportation;
12.2.7 . To have professional personnel to work on waterway transportation craft and training them;
12.2.8 . To purchase tickets to the port of destination and berth for passengers and assign seats corresponding to the tickets;
12.2.9 . In case of a person is born or deceases on a waterway transportation craft, the captain, ancestor, or owner must make a written document every time;
12.2.10 . In case of the destruction of the watercraft cannot be avoided, captain, crew members and helmsman shall allow the crew members to abandon the waterway transportation craft after they have taken all measures to save the passengers. The captain and helmsman shall be the last to leave the waterway transportation craft;
12.2.11 . Captains, crew members, and helmsman of waterway transportation crafts who have received calls for danger, accidents, or catastrophes, or who have found a person in danger of drowning in the water, shall ensure their own safety and provide assistance to them.
Article 13. Prohibition in the operation of the carrier
13.1 . Captains, crew members, ancestors, owners and helmsman of waterway transportation crafts shall be prohibited from taking actions as follows:
13.1. 1 . To drive a waterway transportation craft while under the influence of alcohol, narcotic drugs or substances;
13.1.2 . To avoid being checked by the state inspector of waterway transportation control and other authorized officials about whether or not they have drunk alcoholic beverages;
13.1.3 . To make sharp turns in the water and performing other types of performances in order to attract the attention and interest of passengers and travelers while transporting them;
13.1.4 . To transport passengers and travelers without life jackets or with non-compliant life jackets;
13.1.5 . when participating in navigation, to obstruct the navigation of other crafts by overtaking them, passing on the wrong side, weaving in the direction of navigation, or going around the front and back;
13.1.6 . To let drive a craft by a person who is not authorized to drive a waterway craft;
13.1.7 . To transport children under the age of 16 without a guardian or supporter;
13.1.8 . To increase and change the engine capacity specified by the manufacturer and intended purpose of the waterway transportation craft;
13.1.9 . To voyage with incomplete or damaged waterway transportation craft;
13.1.10 . others prohibited by law.
Article 14. Rights and obligations of passengers and customers
14.1 Passengers and customers shall have the following rights:
14.1.1 To refuse to use crafts that do not meet the transportation conditions and technical requirements and are not intended for use;
14.1.2 To require the carrier to adhere to the specified route of the waterway and the period agreed upon in the contract;
14.1.3 other rights provided by law.
14.2 . Passengers and customers shall undertake the following obligations:
14.2.1 . To determine the type and size of the shipment, the direction, time and conditions of transportation, and conclude a transportation contract;
14.2.2 . packaging, packing, boxing and fastening of shipment according to standards and preparing for separate transportation by type and dispatch;
14.2.3 . To determine the total weight of the cargo and indicate it in the transport document, handing over other documents determined by border, customs, quarantine, hygiene rules and regulations;
14.2.4 . To load and unload machinery, additional equipment, and manpower ready to load and unload cargo within the specified time, and receive shipment with its own address or under contract;
14.2.5 . To provide the carrier with information on the transportation and storage of cargo;
14.2.6 . To hand over the shipment to the carrier, certifying that the cargo has been loaded and received in the transport document;
14.2.7 . not to carry items that may cause harm or danger to the life and health of others while traveling by waterway transportation;
14.2.8 . not to break or damage waterway transport craft or pollute the environment;
14.2.9 . each passenger using the waterway transportation craft shall get a ticket;
14.2.10 . the passenger must strictly comply with and fulfill the law, rules, regulations, instructions and legal requirements set by authorized persons regarding the safe operation of waterway transportation;
14.2.11 . passengers to maintain public order and internal regulations operating on waterways.
Article 15. Passenger Prohibition
15.1 . The following actions and omissions of passengers by waterway transport are prohibited:
15.1.1 . To operate a waterway craft while under the influence of alcoholic beverages, narcotic drugs or substances, acting in a manner that threatens the safety of the navigation of the waterway craft, not complying with the legal requirements set by the authorized person to ensure safety, wear a life jacket, verbal abuse, and other committing illegal acts;
15.1.2 . To avoid being examined by the captain, ancestor, owner, helmsman, state inspector, or other authorized officials of the waterway transportation craft for whether or not they have consumed alcoholic beverages, narcotic drugs, or other substances;
15.1.3 . Passenger, who is demanding or threatening the captain, crew members, ancestor and owner of the ship to urge others to stand up, demand to make sharp turns in the water, perform stunts, overtake other vehicles, go around in front of or behind them, or do other illegal actions while traveling on a water transport vehicle;
15.1.4 . not wearing a life jacket that fits the body, not fastening the straps and buttons of the life jacket, intentionally wearing a life jacket that does not meet the requirements;
15.1.5 . To require the transfer of the steering wheel of a water vehicle;
15.1.6 . others prohibited by law.
CHAPTER FIVE
TECHNICAL CONTROL AND INSURANCE
OF WATERWAY TRANSPORTATION CRAFT
Article 16. Technical control and inventory
16.1 . The central state administrative body in charge of waterway transportation, or its authorized organization, shall annually conduct a technical inspection of waterway transportation crafts on the level of acceptable levels of factors that have a negative impact on the health of the population and the environment, and on the compliance with the rules of transportation and technical use and making a note on the waterway transportation craft certificate on every occasion.
16.2 . It is forbidden to conduct navigation if the waterway transportation craft specified in Article 8.1 of this law has not passed the technical control inspection.
16.3 . Procedures for conducting technical inspections, keeping records, and issuing license plates for waterway transportation crafts shall be approved by the member of the Government in charge of waterway transportation.
Article 17. Insurance
17.1 . The captain of a waterway transportation craft, regardless of whether he is the owner of the vehicle or not, must be insured with captain's liability insurance.
17.2 . Citizens, enterprises and organizations engaged in passenger transportation services by waterway transportation craft shall have taken out life insurance for others.
17.3 . The life and health of the captain of the waterway transportation craft while performing his/her official duties shall be insured by the employing citizen, enterprise, or organization.
17.4 . In case of the owner and captain of a waterway transportation craft is not insured with the insurance specified in Articles 17.1-17.3 of this law, it shall be prohibited to participate in the navigation of the waterway, subject the craft to technical inspection, and register it in the state register.
CHAPTER SIX
CONTROL OF WATERWAY TRANSPORTATION
Article 18. Implementation of waterway transportation control
18.1 . In accordance with Article 10.4 of the Law on State Control and Inspection, supervision of the safety of waterway transport and the use of waterway crafts shall be carried out by the chief state inspectors and state inspectors of professional inspection centers and local organizations, as well as the inspection service of the central state administrative body in charge of waterway transportation, shall be implemented by the authorized chief state inspector of waterway transportation and the state inspector.
18.2 . State inspectors shall have the right to be provided with labor protection clothing, crafts and equipment required for the performance of their official duties, and have the right to freely access and travel to buildings, berths, and waterway transport crafts used for waterway transportation.
CHAPTER SEVEN
MISCELLANEOUS
Article 19. Liabilities for violation of law
19.1 . If the person who violates the law on waterway transportation is not criminally liable, the judge and the state inspector of waterway transportation control shall impose the following penalties on the guilty person:
19.1.1. In cases of violation of Article 12.2 of this law inpidual shall be imposed with the fine of 5,000-30,000 MNT, enterprises and organizations shall be imposed with the fine of 100,000-250,000 MNT;
19.1.2. In cases of violation of Article 14.2.7 and 14.2.8 of this law, inpidual shall be imposed a fine of 1000-5000 MNT;
19.1.3. The imposition of a fine on a violator of the Law on Waterway Transportation shall not become a reason to remove the violation or to compensate others for the damage caused by the violation.
Article 20. Coming into force
20.1 . This law shall come into force on July 1, 2017.
